This Privacy Notice describes how Vayda, Inc. (“we”, “us”, “our”) collects, uses and discloses information about you when you use our websites (vayda.com, vayda.ai, and Vayda.ag), platform, applications, services, tools and features, or otherwise interact with us (collectively, the “Services”). For the purposes of this Privacy Notice, “you” and “your” means you as the user of the Services. Please note that the Services are designed for users in the United States only and are not intended for users located outside the United States.

When you use or access the Services, we collect certain categories of information about you from a variety of sources.
Information You Provide to Us
Some features of the Services may require you to directly provide certain information about yourself. You may elect not to provide this information, but doing so may prevent you from using or accessing these features.
Information that you directly submit through our Services includes: Basic contact details, such as name, address, phone number, email. We use this information to create and maintain your account and provide the Services, and to communicate with you. Account information, such as username and password. We use this information to provide the Services and to maintain and secure your account with us. If you choose to register an account, you are responsible for keeping your account credentials safe. We recommend you do not share your access details with anyone else. If you believe your account has been compromised, please contact us immediately. Any other information you choose to include in communications with us, for example, when you fill out a user survey, request support, send a message through the Services or contact us.
Information Collected Automatically
We may also use cookies or other tracking technologies to automatically collect certain information about your interactions with the Services. We collect and use this information to tailor your experience with the Services, provide you with relevant information, run analytics, better understand user interactions with the Services to optimize the experience, monitor the quality of our Services, etc. Such information includes: Device information, such as operating system and internet protocol (IP) address. Other information regarding your interaction with the Services, such as browser type, log data, date and time stamps, clickstream data, interactions with marketing emails, and ad impressions. Information we receive when you choose to use a third-party sign on option, such as Google single sign on or Meta.
Most browsers accept cookies automatically, but you may be able to control the way in which your devices permit the use of cookies. If you so choose, you may block or delete certain of our cookies from your browser; however, blocking or deleting cookies may cause some of the Services, including any portal features and general functionality, to work incorrectly. We may use any of the above information to provide you with the Services and to maintain our business relationship, including by enhancing the safety and security of our Services (e.g., troubleshooting, data analysis, testing, system maintenance, and reporting), providing customer support, sending service and other non-marketing communications, monitoring and analyzing the use of the Services, conducting internal research and development, complying with applicable legal obligations, enforcing any applicable terms of service, and protecting the Services, our rights, and the rights of our employees, users or other individuals. Such information includes: Information we receive when you choose to use Google or Meta to sign-in your account, which we use to maintain your account and login information. Analytics data we receive from analytics providers such as Google Analytics, Microsoft Clarity and Hubspot.
Any information we receive from outside sources will be treated in accordance with this Privacy Notice. We are not responsible for the accuracy of the information provided to us by third parties and are not responsible for any third party’s policies or practices. Finally, we may deidentify or anonymize your information such that it cannot reasonably be used to infer information about you or otherwise be linked to you (or we may collect information that has already been deidentified/anonymized), and we may use such deidentified/anonymized information for any purpose.

We may disclose your information for legitimate purposes subject to this Privacy Notice, including the following categories of third parties:

- Vendors or other service providers who help us provide the Services, including for system administration, cloud storage, security, customer relationship management, marketing communications, web analytics, payment networks, and payment processing.

- Third parties to whom you request or direct us to disclose information, such as through your use of login integration.

Despite our reasonable efforts to protect your information, no security measures are impenetrable, and we cannot guarantee “perfect security.” Any information you send to us electronically, while using the Services or otherwise interacting with us, may not be secure while in transit. 5. SMS Policy
This section details how we handle information you provide through our SMS program:
Use of Information
Purpose: We use your information to send mobile messages and respond to your inquiries as necessary. This may involve sharing your information with platform providers, phone companies, and other vendors who assist in message delivery.
Protection of Information: We do not sell, rent, loan, trade, lease, or otherwise transfer for profit any phone numbers or customer information collected through the SMS program to any third party.
Disclosure: We may disclose your information if required by law, regulation, or governmental request, to avoid liability, or to protect our rights or property.
Choices and Controls
Consent: Consent to receive automated marketing text messages is not a condition of any purchase.
Opt-Out: You can opt out of receiving further text messages via the Messaging Service by responding to any of our text messages with "STOP".
Your Responsibilities
Accurate Information: Ensure that the information you provide is accurate, complete, and truthful. Do not use a false or misleading name or a name you are not authorized to use.
Consequences: If we believe the information provided is untrue, inaccurate, or incomplete, or if you have joined the program for ulterior motives, we may deny you access to the program and take appropriate legal actions.
This Section 6 is strictly limited to our SMS program and does not affect any other privacy policies that may govern your relationship with us in other contexts. Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
